\u00bfEs realmente importante hacer el testamento?<\/strong><\/h2>\n

Sin lugar a dudas, la respuesta es s\u00ed<\/strong> y cuanto m\u00e1s detallado, mejor. Su creaci\u00f3n es fundamental, b\u00e1sicamente porque el testamento, es un documento legal que certifica qui\u00e9n ser\u00e1 el beneficiario de nuestros bienes cuando nosotros ya no estemos. Es importante, incluso si solo se tiene dinero en el banco<\/strong> y no se poseen viviendas ni fincas.<\/p>\n

Entre sus ventajas<\/strong> encontramos:<\/p>\n

  • La persona viuda puede quedar mejor posicionada<\/strong> si en el texto, dejamos claro que queremos que tenga m\u00e1s derechos que por ley le hubiesen correspondido.<\/li>\n
  • Si no tenemos familiares<\/strong>, es totalmente recomendable ponernos en manos de un notario y cederle nuestra herencia a alguna persona de confianza,<\/strong> ya que de no ser as\u00ed, nuestros bienes acabar\u00e1n en manos del Estado.<\/li>\n
  • Su creaci\u00f3n est\u00e1 al alcance de cualquier bolsillo.<\/strong><\/li>\n<\/ul>\n

    \"Firmar<\/p>\n

    \u00bfSe puede modificar sin que nadie se entere?<\/strong><\/h2>\n

    El C\u00f3digo Civil<\/strong> reconoce siempre el \u00faltimo testamento<\/strong> que se haya realizado. El anterior a este queda invalidado. Adem\u00e1s, aunque los c\u00f3nyuges suelen entrar juntos al despacho del notario y se les hace una lectura del documento a ambos, cada una de las personas ha de firmar su propio testamento. Por esta raz\u00f3n, se puede modificar el escrito sin que ning\u00fan familiar se entere. \u00a0<\/strong>No es necesario acudir a la misma notar\u00eda para hacer uno nuevo.<\/p>\n

    \u00bfHay que cambiar el testamento en caso de divorcio o separaci\u00f3n?<\/strong><\/h2>\n

    Es de vital importancia modificar el testamento excluyendo al ex c\u00f3nyuge de nuestros bienes,<\/strong> ya que el C\u00f3digo Civil, no determina la ineficacia de la cl\u00e1usula a favor de la esposa o el esposo por el divorcio posterior.<\/p>\n

    En tres Comunidades Aut\u00f3nomas, concretamente en Calatu\u00f1a, Arag\u00f3n y Galicia,<\/strong> s\u00ed que ese testamento queda sin validez una vez exista un documento legal que certifique una separaci\u00f3n. De igual forma, lo ideal es hacer uno nuevo para evitar posibles imprevistos.<\/p>\n
